How Much Weed Can You Legally Carry in New York?
Legal since 2021, but the rules on how much and where still trip people up. Here is what an adult can carry, buy, and keep in New York, and the spots around the city where lighting up is still off limits.

The Short Answer
Adults 21 and over can carry up to 3 ounces of flower and 24 grams of concentrate for personal use in New York.
You can consume where tobacco smoking is allowed, but never in a car and not where smoking is banned. Buy only from a licensed dispensary and always have ID.
New York legalized adult-use cannabis in 2021 with the MRTA, and the city has been sorting out the details ever since. The limits are actually generous, more than most people carry on a normal day, but the where and the how still catch people out. Here is the plain version. Treat it as a starting point, not a lawyer.
How Much You Can Carry
If you are 21 or older, New York lets you possess, on your person, for personal use:
- Up to 3 ounces of cannabis flower. That is 84 grams, or about 24 eighths. A lot.
- Up to 24 grams of concentrate, covering vapes, concentrates, and the cannabis in edibles.

How Much You Can Keep at Home
At your residence, the personal-use allowance is higher, up to five pounds of cannabis stored at home. Practically nobody keeps that much, but it is the number in the law. Where You Can and Cannot Use It
This is the part that trips up even longtime New Yorkers. The rule of thumb: you can generally smoke or vape cannabis wherever tobacco smoking is allowed. But there is a long list of exceptions.
- Never in a vehicle, moving or parked. Not as the driver, not as a passenger. This one is strict.
- Not where tobacco is banned, which includes many parks, beaches, boardwalks, pedestrian plazas, and within a set distance of schools.
- Not indoors where smoking is prohibited, including workplaces, bars, restaurants, and most apartment building common areas.
- Private property is up to the owner. Your landlord or building can prohibit smoking, and many do.
When in doubt, treat it like a cigarette and add extra caution near schools, in parks, and anywhere in a car. This is exactly why delivery to your own place is the simplest path.
Buying: Licensed Only
Carrying and using are legal within these limits, but buying is only legal from a licensed dispensary. A Few Things That Are Still Illegal
- Selling without a license. Gifting small amounts between adults is allowed, selling is not.
- Driving impaired. A DWI applies to cannabis just as it does to alcohol.
- Carrying across state lines. Cannabis is still federally illegal, so taking it out of New York, including on a plane or across a bridge to Jersey, is a federal matter.
- Anyone under 21. The whole adult-use framework starts at 21.
